These Terms of Use (the “Terms”) govern access to and use of RentFund’s website, application, payment-option flow, payment delivery service, communications, and related products and services (collectively, the “Service”). By accessing or using the Service, submitting a request, viewing payment options, accepting any payment option, creating an account, using the app, or receiving funds sent by or through RentFund, you agree to these Terms and the policies incorporated by reference below.

If you do not agree to these Terms, do not use RentFund.

1. RentFund’s Role

RentFund is a rent payment support and payment delivery service. RentFund helps users access available payment options, receive approvals from third-party providers where applicable, and have rent-related funds sent by e-transfer, direct deposit, or another supported method selected through the Service.

RentFund is not your landlord, property manager, lender, broker, bank, credit reporting agency, debt collector, financial advisor, legal advisor, or tenancy advisor. RentFund does not become a party to your lease, tenancy, or rent obligation.

• RentFund does not guarantee that any payment option will be available to you.

• RentFund does not guarantee approval by any third-party provider.

• RentFund does not guarantee that your rent will be paid by any specific deadline.

• RentFund may delay, reject, cancel, or suspend a request if required information is missing, inaccurate, suspicious, incomplete, or cannot be verified.

2. Access Through Website or App

Users may be able to view payment options through the RentFund website without first creating an app account. Some features may require app access, account creation, identity verification, document submission, or additional steps.

The app may allow users to track payment status, view payment history, make or manage additional payments, upload proof documents, receive notifications, manage account information, and access special offers or additional features. App access is optional unless RentFund states that a specific feature or transaction requires it.

3. Payment Options and Third-Party Providers

Some payment options may be provided, approved, financed, processed, or administered by third-party providers. These providers may include payment processors, financial institutions, installment-payment providers, credit providers, banking partners, fraud prevention providers, identity verification providers, and technology vendors.

A third-party provider may require a soft credit check, identity verification, repayment agreement, payment authorization, or other eligibility review. RentFund does not control third-party decisions and is not responsible for a denial, approval, repayment schedule, provider fee, late fee, credit decision, account action, or provider error.

4. Sending Funds

Once a request is approved and all required steps are completed, RentFund will attempt to send funds using the selected payment method, such as e-transfer or direct deposit. Funds may be sent to the landlord, property manager, authorized rent recipient, or directly to the user if the Service permits direct-to-user funding.

Funds are normally sent within twenty-four (24) hours after approval and completion of all required information, but this timing is not guaranteed. Processing may be delayed by missing or incorrect information, recipient action, third-party provider delays, Stripe or banking delays, holidays, weekends, compliance checks, fraud review, failed verification, technical issues, or events outside RentFund’s control.

• RentFund may send funds in your name or identify the payment as being sent on your behalf.

• You are responsible for ensuring that the correct recipient and transfer details are provided.

• RentFund is not responsible for losses, late rent, fees, penalties, eviction consequences, landlord disputes, or failed transfers caused by incorrect, incomplete, outdated, or fraudulent information.

5. Direct-to-User Funding and Proof of Rent Use

If funds are sent directly to you instead of to your landlord, property manager, or other rent recipient, you agree that the funds must be used only for the purpose of paying rent.

You must provide acceptable proof that the funds were used for rent within the timeframe requested by RentFund. Unless otherwise stated by RentFund, proof must be provided within five (5) business days after the funds are sent to you or within five (5) business days after RentFund requests proof, whichever is earlier.

Acceptable proof may include a rent receipt, bank statement showing the rent transfer, landlord confirmation, property-management portal receipt, lease portal confirmation, or another form of proof approved by RentFund. If you provide a bank statement or similar document, you may redact unrelated transactions, balances, or personal information, provided that the document still clearly shows the rent-related transfer, the payment amount, the payment date, and the recipient.

RentFund may reject proof that is incomplete, unclear, altered, inconsistent, unverifiable, or not reasonably connected to a rent payment. RentFund may also contact your landlord, property manager, rent recipient, or other relevant party to verify that the funds were used for rent, where permitted by law.

If you do not provide acceptable proof within the required timeframe, or if RentFund determines that the funds were not used for rent or cannot be verified as rent-related, RentFund may deny future requests, suspend or restrict your account, cancel access to RentFund services, require the funds to be returned, and take any other action available under these Terms or applicable law.

You remain fully responsible for ensuring that any funds sent directly to you are used for rent and for keeping accurate records showing that your rent payment was made.

6. Direct Deposit and Stripe

RentFund may use Stripe or other third-party payment processors to facilitate direct deposit transfers. If direct deposit is selected, the user, landlord, property manager, or recipient may be required to enter banking or payout details through Stripe or another provider. Failure to provide accurate and complete details may delay or prevent RentFund from completing the Service.

7. Fees and Charges

RentFund may charge service fees, processing fees, or other disclosed fees. Third-party providers may also charge fees, interest, late fees, returned-payment fees, or other amounts under their own terms. Fees and applicable payment terms should be reviewed before completing a transaction.

8. Refunds, Cancellations, and Completed Service

A request may be cancellable before funds are sent, subject to RentFund’s operational status and any third-party provider terms. Once RentFund sends the funds, the Service has been performed and is generally non-refundable.

If a user requests a refund after funds have been sent, RentFund may require the full amount of funding sent by RentFund to be returned to RentFund before any refund, cancellation, reversal, or provider adjustment can be considered. RentFund does not guarantee that a third-party provider will cancel, reverse, refund, or modify any repayment obligation.

9. User Responsibilities

• Provide accurate, complete, and truthful personal, payment, rent, landlord, and recipient information.

• Confirm that the requested amount is rent-related and that the payment details are correct.

• Complete all provider, Stripe, direct deposit, proof, verification, approval, and payment steps required by RentFund or a third-party provider.

• Use direct-to-user funds only for rent and provide proof when required.

• Monitor payment status and allow enough time for processing before rent is due.

• Resolve disputes with landlords, property managers, banks, payment processors, or third-party providers where those disputes are outside RentFund’s control.

10. Prohibited Conduct

• Submitting false, misleading, altered, incomplete, or fraudulent information.

• Using RentFund for non-rent purposes unless expressly permitted by RentFund in writing.

• Submitting fake rent receipts, altered bank statements, false landlord confirmations, or incorrect recipient information.

• Attempting duplicate requests, chargeback misuse, account abuse, system manipulation, unauthorized access, scraping, or misuse of promotional offers.

• Using the Service in a way that violates law, third-party rights, provider terms, payment network rules, or RentFund policies.

11. Service Availability and Changes

RentFund may modify, suspend, discontinue, add, or remove features, payment options, limits, availability, providers, pricing, promotions, or eligibility requirements at any time. RentFund may not be available for all users, provinces, buildings, rent situations, amounts, payment methods, or providers.

12. No Guarantee of Rent Outcome

You remain solely responsible for paying rent on time and complying with your lease. RentFund does not guarantee that rent will be paid, that your landlord will accept a payment, that a transfer will be completed by a specific time, that a third-party provider will approve you, or that use of the Service will prevent late fees, penalties, eviction steps, collection action, or landlord-tenant disputes.

13. Limitation of Liability

To the maximum extent permitted by law, RentFund and its directors, officers, employees, contractors, affiliates, vendors, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of funds, late rent, missed rent, landlord penalties, eviction consequences, credit impact, provider decisions, bank errors, user errors, transfer delays, technical failures, unauthorized third-party conduct, or events outside RentFund’s reasonable control.

Some jurisdictions do not allow certain limitations of liability. In those cases, RentFund’s liability will be limited to the maximum extent permitted by applicable law.

14. Indemnity

You agree to defend, indemnify, and hold harmless RentFund and its directors, officers, employees, contractors, affiliates, vendors, and service providers from claims, losses, damages, liabilities, costs, and expenses arising from your use of the Service, your breach of these Terms, your misuse of funds, your inaccurate information, your disputes with landlords or third-party providers, or your violation of law or third-party rights.

15. Privacy and Communications

Use of RentFund is subject to the Privacy Policy and Electronic Communications Policy. You authorize RentFund to collect, use, disclose, and retain information as described in those policies and to send transactional communications necessary to operate the Service.

16. Governing Law

Unless otherwise required by applicable consumer protection law, these Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law rules.
